VisaPod Terms of Use

Effective date: June 22, 2026

These Terms of Use govern your access to and use of VisaPod. VisaPod is operated by THINKHARD LIMITED, a New Zealand limited company incorporated under company number 9439281 and NZBN 9429053763662.

References to "VisaPod", "we", "us", and "our" mean THINKHARD LIMITED operating the VisaPod service.

Acceptance

By creating an account, signing in, uploading documents, starting a task, paying for a task, or using VisaPod, you agree to these Terms and the Privacy Policy with THINKHARD LIMITED.

If you do not agree, do not use VisaPod.

What VisaPod Provides

VisaPod is a software service that helps users prepare visa application tasks, currently focused on the U.S. DS-160 workflow. The service may use AI systems, uploaded documents, deterministic form data checks, and sandbox browser automation to assist with preparation and form filling.

VisaPod is not a government website, is not affiliated with the U.S. Department of State, USCIS, CEAC, or any other government agency, and does not provide legal advice.

No Legal Advice And No Guarantee

VisaPod provides software assistance and general workflow support. VisaPod does not provide legal advice, immigration advice, representation, or attorney-client services.

VisaPod does not guarantee that any visa application will be accepted, approved, reviewed faster, or produce any specific immigration outcome.

You are responsible for reviewing all information before submitting any government form. You should consult a qualified attorney or authorized immigration professional if you need legal advice.

Eligibility

You must be at least 18 years old, or the age of legal majority where you live, to create an account or use VisaPod. If you use VisaPod on behalf of another person, dependent, client, applicant, or family member, you represent that you have authority to do so.

Your Responsibilities

You agree to:

  • Provide accurate, complete, and lawful information.
  • Review all generated, extracted, mapped, or filled information before submission.
  • Keep your account secure.
  • Upload only documents that you have the right to use.
  • Comply with applicable laws and government instructions.
  • Stop using VisaPod if you believe it is producing incorrect or unsafe results.

You must not:

  • Submit false, misleading, fraudulent, or forged information.
  • Use VisaPod to impersonate another person without authorization.
  • Upload malware, illegal content, or documents you are not allowed to provide.
  • Attempt to bypass rate limits, payment gates, sandbox controls, or security controls.
  • Use VisaPod to violate the terms of any government website or third-party service.
  • Resell or operate VisaPod as a managed service without written permission.

Uploaded Documents

You retain ownership of your uploaded documents and user-provided information. You grant VisaPod permission to store, process, analyze, transmit, and display that information only as needed to provide, secure, debug, and support the service.

Uploaded documents may contain sensitive personal information. Do not upload documents unless you are comfortable with VisaPod processing them as described in the Privacy Policy.

AI And Automation Limits

VisaPod uses AI and browser automation. These systems can fail, misunderstand context, enter incorrect information, lose state, or be interrupted by third-party website changes, captchas, downtime, network issues, or sandbox limits.

VisaPod may pause a task and ask for user intervention. VisaPod may also stop or retry a task for safety, reliability, payment, or capacity reasons.

Payments

Paid features are unlocked through Stripe checkout or another payment provider shown at checkout. Prices, included features, and task scope are shown before payment.

Payment does not guarantee a visa outcome or government acceptance. Payment covers access to VisaPod's software-assisted workflow for the purchased task or plan. Payments are processed for THINKHARD LIMITED through the payment provider shown at checkout.

Refunds are governed by the Refund Policy.

Beta Service

VisaPod may be offered as a beta service. Beta features may be incomplete, unstable, rate-limited, unavailable, changed, or discontinued.

VisaPod may limit concurrent tasks, sandbox sessions, uploads, file sizes, or other resource usage to keep the service reliable.

Third-Party Services

VisaPod depends on third-party providers for AI models, sandbox browsers, file storage, authentication, email, bot protection, payments, analytics, hosting, and databases. VisaPod is not responsible for failures, downtime, policy changes, pricing changes, or security incidents caused by third-party providers, except where applicable law says otherwise.

Account Suspension Or Termination

VisaPod may suspend or terminate access if you violate these Terms, create security risk, abuse the service, trigger payment fraud or chargebacks, violate applicable law, or create excessive operational risk.

You may stop using VisaPod at any time.

Intellectual Property

VisaPod and its software, interface, workflows, prompts, automation logic, and generated product materials are owned by THINKHARD LIMITED or its licensors. You may not copy, reverse engineer, resell, or misuse the service except as allowed by law or written permission.

Your uploaded documents and user-provided information remain yours.

Disclaimers

VisaPod is provided "as is" and "as available." To the maximum extent allowed by law, VisaPod disclaims warranties of accuracy, reliability, availability, fitness for a particular purpose, non-infringement, and uninterrupted operation.

Limitation Of Liability

To the maximum extent allowed by law, THINKHARD LIMITED and VisaPod will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages, including lost profits, lost opportunities, visa denial, travel disruption, business interruption, data loss, or government processing delays.

To the maximum extent allowed by law, THINKHARD LIMITED's total liability for a paid task will not exceed the amount you paid for that task in the three months before the event giving rise to the claim.

Some jurisdictions do not allow certain limitations, so some limitations may not apply to you.

Indemnity

You agree to defend and indemnify THINKHARD LIMITED and VisaPod from claims, losses, liabilities, damages, costs, and expenses arising from your misuse of the service, unlawful uploads, false information, unauthorized representation of another person, or violation of these Terms.

Governing Law And Disputes

These Terms are governed by the laws of New Zealand, unless mandatory consumer or privacy law requires otherwise. You and THINKHARD LIMITED will first try to resolve disputes by contacting each other in good faith. If a dispute cannot be resolved informally, it may be handled by the courts or dispute resolution bodies that have jurisdiction under applicable law.

Changes

VisaPod may update these Terms. Updated Terms will be posted on this page. Continued use after changes means you accept the updated Terms.
